Article 1. Scope
These general terms and conditions apply to all offers, orders, agreements and all legal acts, deliveries and work carried out by Healthy Skinfood. Deviations and additions to these conditions only bind Healthy Skinfood if agreed in writing. Accepting an offer or placing an order means that you accept the applicability of these conditions. Terms and conditions and / or other conditions used by the other party are not recognized by Healthy Skinfood.
Article 2. Realization
2.1. All offers and quotations of Healthy Skinfood are without obligation and Healthy Skinfood reserves the right to change the prices, especially when this is necessary on the basis of (legal) regulations.
2.2 An agreement is only concluded after acceptance of your order by Healthy Skinfood. Healthy Skinfood is entitled to refuse orders or to attach certain conditions to the delivery, unless explicitly stated otherwise. If an order is not accepted, Healthy Skinfood will communicate this within 3 working days after receiving the order.
Article 3. Prices and payments
3.1 The prices stated for the products and services offered are in euros including VAT.
3.2 For shipping within the Netherlands, Belgium, Luxembourg and Germany we charge €6,95 per shipment. There are no shipping costs for orders higher than €50. For worldwide delivery, the shipping costs depend on the delivery address.
3.3 After placing an order you will immediately receive a confirmation by email with the total costs. Payment always takes place in advance with one of the following methods: iDEAL, Paypal, credit card, Bancontact / Mister Cash or SOFORT Banking. No additional costs are charged for online payments.
Article 4. Delivery
4.1 We ship all orders placed before 13:00 the same day to the delivery address. Orders placed after 13:00 will be shipped the next day. If we deviate from this for certain reasons, you will receive a message via e-mail.
4.2 Exceeding the agreed delivery times does not entitle the customer to compensation, dissolution of the agreement or non-fulfillment of any obligation that may arise from this or from any other related agreement, except when it appears otherwise from the following.
4.3 The product must be delivered to the customer no later than 30 days after ordering. If this does not happen, the customer can immediately cancel the purchase. This does not apply if the parties have agreed to a different delivery period.
4.4 Healthy Skinfood is entitled to deliver in parts. In that case, the delivery time will be specified per partial delivery.
4.5 We try our best to keep the website as up-to-date as possible, but it can happen that a product is no longer available. In this case, we will contact you as soon as possible.
Article 5. Right of withdrawal
5.1 As a consumer you have a cooling-off period of 14 days after you have received the product. This period starts on the day after the product has been received by you or on your behalf. During this period, you as a customer will handle the product and packaging carefully. You may only unpack the product to the extent that is necessary to assess whether you wish to keep the product. It is not possible to return opened or used products.
5.2 You can use this right by returning the product to us within this period, or informing us that you are cancelling the purchase within this period, and then returning the product as soon as possible.
5.3 We expect an undamaged product. If damage to the product has occurred, we can charge you for this damage or refuse the return shipment entirely. The costs for return shipments are at the expense of the customer. The amount already paid will be refunded within 14 days after the order has been returned.
5.4 You need to inform us about the return via firstname.lastname@example.org with your ordernumber and the products you wish to return. You can send the products back to our warehouse De Brink (Ir. Hanlostraat 15, 7547 RD Enschede).
5.5 The right of withdrawal does not apply to business buyers.
Article 6. Liability
6.1 Any liability of Healthy Skinfood and its products for damages of any kind, direct or indirect, is explicitly excluded. Healthy Skinfood is also not liable for the damage caused by third parties in the execution of the agreement.
6.2 Healthy Skinfood accepts no liability for any damage resulting from the use of Healthy Skinfood products.
6.3 Liability of Healthy Skinfood towards the buyer is in any case limited to a maximum of the invoice amount that the buyer owes to Healthy Skinfood from the specific agreement.
Article 7. Force majeure
7.1 In the event of force majeure, Healthy Skinfood has the right to suspend the execution of your order, or to dissolve the agreement without judicial intervention, such by communicating this in writing and without any compensation by Healthy Skinfood.
7.2 Force majeure means any shortcoming that can’t be attributed to Healthy Skinfood, because it is not due to her fault and not under the law, legal act or generally accepted for its account.
Article 8. Privacy
All personal data will only be used for the processing of orders and communication with the customer. Personal data will never be shared with third parties.
Article 9. Retention of title
We reserve the ownership of all goods until the moment of full payment of the goods delivered or to be delivered to the customer.
Article 10. Applicable law and competent court
10.1 All rights, obligations, offers, orders and agreements to which these terms and conditions apply, in whole or in part, are governed exclusively by Dutch law.
10.2 All disputes between parties, resulting from offers and agreements will be submitted exclusively to the competent court.
